The Divorce Process in Palm Beach County

  1. Filing the Petition: One spouse files a Petition for Dissolution of Marriage with the circuit court in the appropriate county. The other spouse is then served and has 20 days to file a response.
  2. Financial Disclosures: In most cases, both parties are required to file mandatory financial disclosures, including sworn financial affidavits that detail income, expenses, assets, and liabilities.
  3. Discovery: In contested cases, both sides may conduct formal discovery, which can include interrogatories, requests for production of documents, depositions, and subpoenas to third parties such as banks and employers.
  4. Mediation: Most family law cases are required to go through mediation before proceeding to trial. Mediation is a confidential process in which a neutral third party works with the attorneys and the parties to negotiate a settlement.
  5. Trial: If the parties are unable to reach an agreement through mediation or negotiation, the case proceeds to trial, where a judge will make the final decisions on all unresolved issues.
  6. Final Judgment: Once all issues are resolved, either by agreement or by the court, a Final Judgment is entered. In a divorce case, a Final Judgment of Dissolution of Marriage officially ends the marriage and returns each party to the status of being single
